On what constituted to be an illegal strike in the case of the Chinese SMRT drivers, SMU Assistant Professor of Law Eugene Tan commented that according to the law, strikes need to be approved and must be done through proper procedures; otherwise, it would be deemed illegal. He added that as long as the drivers were a part of the strike, it did not matter whether or not they had applied for sick leave.
