Limited chance of legal action

In his interview with CNA’s “Business Singapore” programme on 24 Jun 2013, NMP and SMU Assistant Professor of Law Eugene Tan shared his views on the recent haze problem in Singapore.  He commented that options were somewhat limited when it came to legal action that could be taken to tackle such trans-boundary pollution as there had been no environmental laws with an extra-territorial reach. As such, our laws have no jurisdiction over offences being committed in a foreign territory.  Even if we had laws with extra-territorial reach, gathering evidence against the errant companies or individuals responsible for causing the smog would be a problem. This was because the Indonesian authorities might not allow Singapore’s investigators to enter into the country and gather evidence to mount a prosecution.
