In a commentary, SMU Associate Professor of Law Eugene Tan explained the two fundamental considerations of Singapore's apex court's decision to preserve the legislative status quo on S377A. He also noted that Home Affairs and Law Minister K. Shanmugam and Social and Family Development Minister Masagos Zulkifli made statements on the court's judgment during their ministries' Committee of Supply debates which gave an insight into the Government's thinking. He pointed out the urgent need for Singapore to strengthen its constitutional culture, especially the freedom of religion and the freedom of speech, and have confidence in its own beliefs and values. He concluded that while the law and the legal system can provide the structure and rules, they cannot imbue us with the requisite values and norms to build bridges across differences.
